TERMS & CONDITIONS

 

Please read the following terms and conditions carefully before registering on, accessing, browsing, downloading or using the YOJO website located at yojo.co.in, and all associated sites linked to YOJO or any similar platform, hereinafter collectively, the YOJO Platform run by “Nuptials Events Management Services Pvt Ltd” (hereinafter collectively referred as “Nuptials or YOJO”), having its registered office at 18-4-278 & 18-4-279 Gollaguda, O/S Aliabad, Falaknuma, Hyderabad, Telangana 500053 India. YOJO is only a platform that connects prospective wedding clients and vendors that the Clients are willing to associate with to undertake their services.

 

These Terms of Use (this “Agreement”) set forth the legally binding terms for your use and are to be complied with in addition to any agreement or terms agreed upon between the Parties for the YOJO Services. By using the YOJO services, whether as a “Visitor” (meaning you simply browse the YOJO website) or as a “User” (meaning you have registered with and/or submitted content to the YOJO website as an individual or as a company), you agree to be bound by this Agreement located at …………………… (Website address where the policy is displayed to be mentioned here).

 

This Agreement includes your rights, obligations and restrictions regarding our use of the YOJO Services, please read it carefully. The term “Customer” shall refer to individuals or Parties undertaking the YOJO Services through the YOJO platform and the term “Vendor” refers to the individual or entities listed on the YOJO Platform who provide services independently to the Customers.

 

YOJO may modify this Agreement from time to time and each modification will be effective when it is posted on the …………………………… website. You agree to be bound to any changes to this Agreement through your continued use of the YOJO Services. You will not be notified of any modifications to this Agreement so it is important that you review this Agreement regularly to ensure you are updated as to any changes.

 

1.    Eligibility

Use of the YOJO services is void where prohibited. By registering, you (i). represent and warrant that you have the right, authority and capacity to enter into and to fully abide by all of the terms and conditions of this agreement as far as age, jurisdiction, laws of the land, etc are concerned and (ii) agree to comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of the YOJO Services.

 

2.    Term

This Agreement shall remain in full force and effect while you use the YOJO services or are a User/Vendor on the website. YOJO may terminate your use of these services, in its sole discretion, for any reason or no reason whatsoever, at any time, without warning or notice to you. Upon such termination of the agreement, the User shall be stopped from using YOJO Services and all content shall remain to be property of YOJO.s

3.    Reviews of Vendor Profiles

Reviews written for vendors on their YOJO profile are a very important tool for customers as well as vendors. We, therefore, take utmost care to uphold the integrity and credibility of reviews on our platform. You can report a review as being false to YOJO for verification at ………………….. (Email id/website to be specified). YOJO team will contact the Vendor within 4 hours and ask them to submit the proof within 7 days after being contacted. YOJO has the sole discretion to decide whether reported reviews are to be further investigated or not. YOJO prides itself in ensuring authentic and genuine reviews that can help engaged couples make better hiring decisions.

 

4.    User Disputes

Users are solely responsible for their interactions with other YOJO users (including Vendors). YOJO reserves the right but has no obligation, to monitor disputes between you and other Users and to immediately terminate the privileges of any User for any reason or no reason. YOJO is only a listing platform and no associations, interactions, or bookings that happen on the YOJO platform are the responsibility of YOJO.

 

5.    Mode of Payments and Policies

Our payment gateway is completely secure and customers can make online payments through a safe transaction process that ensures their security codes will not be revealed in any circumstances. Modes of payments available at YOJO for online bookings are:

 

i). Credit/Debit Cards (Visa, Master, Amex, Maestro & RuPay)

ii). Net Banking (All Major Banks Supported)

iii). Wallet MobiKwik, PhonePe, AmazonPay & Others

iv). UPI

v). GooglePay

vi). EMI (……………………..Names of Banks to be mentioned) and Other banks for EMI

 

6.    Prohibited Content

YOJO reserves the right, in its sole and absolute discretion, to determine whether the User Content is appropriate; and to remove any User Content, without notice or liability to you, which it determines to be inappropriate. Without limiting the generality of the foregoing, the following is a partial list of the types of User Content that YOJO deems to be inappropriate:

i). Content that criticizes a business or individual beyond that of merely offering an opinion.

ii). Content that exploits people sexually or violently.

iii). Content that contains nudity, violence or offensive subject matter or contains a link to an adult website.

iv). Content that is libellous, defamatory or otherwise tortious language.

v). Content that solicits personal information from anyone under 18.

 

7.    Event Cancellation Policy

Every request for cancellation of an Event made on YOJO is subject to cancellation charges levied by YOJO, which may vary concerning the period of intimation.

You may cancel any Event only by giving at least 120 (One-Hundred and Twenty) days' written notice to us. Any shorter intimation/cancellation of the Event would lead to YOJO charging a certain % of the amount as a Penalty from you on the estimated billing amount. The parties agree and understand that in the event of a cancellation, our actual damages would be difficult to determine. Therefore, the parties agree on the following amounts to be paid by you to us upon notice of cancellation as liquidated damages:

a.    In case of cancellation made more than 120 days before the commencement of the Event, no retention charge will be levied.

b.    In case of a cancellation between 120 days and 90 days before the commencement of the Event, YOJO reserves the right to charge 25% of the total estimated billing as retention.

c.     In case of a cancellation between 90 days and 60 days before the commencement of the Event, YOJO reserves the right to charge 50% of the total estimated billing as retention.

d.    In case of a cancellation between 60 days and 30 days before the commencement of the Event, YOJO reserves the right to charge 75% of the expected bill as retention.

e.    In case of a cancellation less than 30 days before the commencement of the Event, YOJO reserves the right to charge the entire amount of the expected bill as retention.

f.      In case of any No-Shows, the Nuptials reserves the right to charge 100% of the estimated bill as a retention amount.

 

 

8.    Disclaimer of Warranties

YOJO services are provided to you on an “AS IS” and “AS AVAILABLE” basis without Representations or Warranties of any kind and YOJO disclaims any implied or statutory warranties to the maximum extent permitted by applicable law, including without limitation implied warranties of title, non-infringement. Without limiting the generality of the foregoing, YOJO is not responsible for any incorrect or inaccurate content posted on the YOJO platform or in connection with YOJO Services. Under no circumstances shall YOJO be responsible for any loss or damage, including personal injury or death, resulting from the use of the YOJO services, attendance at a YOJO event, any content posted on or through the YOJO services, or from the conduct of any Users of the YOJO services.

 

9.    Limitation of Liability

In no event shall YOJO or any parent Company, Subsidiary, Director, Officer, or Employee of YOJO be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special or punitive damages including lost profit damages arising from use of the YOJO Services, even if YOJO has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, YOJO’s liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, paid by you to YOJO for the YOJO Services availed by you.

 

 

 

10.  Indemnity

You agree to indemnify and hold harmless YOJO any of its company, director, officer, or employee from and against any claims, damages, obligations, losses, and liabilities including but not limited to reasonable attorney’s fees, made by any third party due to or arising out of your use of the YOJO Services in violation of this Agreement and/or arising from: i). your use of and access to the YOJO Services; ii). Your violation of any term of these terms; iii). Your violation of any third party right, including without limitation any copyright, property or privacy right; or iv). Any claim that your User Content caused damage to a third party.

 

11.  Disputes; Choice of Law; Venue

These Terms shall be construed and enforced by the laws of India. If any dispute shall arise between the Parties hereto concerning the construction interpretation or application of any of the provisions of the Terms, such dispute shall be referred to the arbitration by Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English. The judicial seat and venue of arbitration shall be Hyderabad and the courts of Hyderabad shall have exclusive jurisdiction for any applications arising out of the arbitration.

 

12.  Waiver

Neither party’s failure to exercise any right or remedy in consequence under these Terms will not constitute a waiver of such term or condition or prevent the subsequent enforcement of such term or condition unless agreed in writing.

 

13.  Severability

If any of the provisions of this Agreement is found by a court of competent jurisdiction to be invalid, void, illegal, and unenforceable, such provision shall stand severed from this Agreement and the remaining provisions of this Agreement shall remain valid and enforceable and binding on the Parties.

 

14.  Statute of Limitations

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the Service or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.
